• If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

12. Third party rights

• These terms and conditions are for our benefit, your benefit, and the benefit of our member practices and these terms and conditions are not intended to benefit or be enforceable by any other party.
• The exercise of the parties' rights under these terms and conditions is not subject to the consent of any third party.

13. Entire agreement

• Subject to Section 11.1, these terms and conditions, together with our privacy and cookies policies, shall constitute the entire agreement between you and us in relation to your use of our website and shall supersede all previous agreements between you and us in relation to your use of our website.

14. Law and jurisdiction

• These terms and conditions shall be governed by and construed in accordance with English law.
• Any disputes relating to these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of England.

Treatment Terms & Conditions

• I understand the importance of regular general dental examinations and preventative care while wearing orthodontic appliances.
• I understand that if I have opted to for the option to pay in full, the complete balance must be paid at the time of fitting the orthodontic appliance¹
• I understand that if I elect to pay for my treatment by instalments, a payment plan will be set up before starting my treatment and managed by GoCardless².
• I understand that there is an administration fee for every failed payment on the monthly payment plans - currently this fee is £25 per failed payment but will increase subject to our routine price increases. If I do not pay the outstanding balance within the first 7 days, I understand there is a weekly late payment charge of £25 added to my account.
• I understand there may be additional fees for lost or broken appliances and agree to pay these fees, if charged.
• If I have opted to have a Full Clear Aligner treatment package, I understand that refinements are included in the cost provided there is evidence of regular scanning on DentalMonitoring and good compliance with the treatment protocol. If there is poor compliance or lack of regular scans present on DentalMonitoring, all refinements are chargeable as well as charges for additional treatment time. If I have opted for a limited aligner package, I understand that further refinements are at an additional fee which I agree to pay.
• Aligners must be worn a minimum of 22 hours a day as instructed.
• I understand that elective removal of attachments/braces for any reason other than end of treatment is not included in the treatment fee.
• I understand that I have an allocated treatment time which has been prescribed by the Orthodontist whether I have chosen braces or Invisalign. If I go over the allocated treatment time, I understand I will need to pay for further treatment time at BeClear.
• I understand that I must wear elastics as instructed for my orthodontic treatment. If I do not wear my elastics, there will be a compromise on the finished result and further charges will apply to extend the treatment time.
• I understand that my aligners must be worn as prescribed for 22 hours a day as a minimum in order for treatment to progress.
• I understand and agree to pay the fees associated with missed appointments or late cancellations (cancellations within 24 hours of the appointment).
• Appointments of 1 hour or longer (brace/attachment fits and removal appointments) carry a late cancellation fee starting at £250 if cancelled with less than 24 hours notice.
• I understand that late attendance to appointments will mean the appointment falls under the late cancellation fee.
• I understand and agree to pay for my refinement aligners and further treatment time for braces if I have not been scanning as instructed on the DentalMonitoring app.
• I understand that scanning on DentalMonitoring is a mandatory requirement of my treatment and failure to scan will incur additional charges.
• I understand that any additional dental work which could affect the fit of my retainers will mean I will need to buy a new retainer.
• I understand that once my braces are removed or clear aligner attachments are removed, that is the end of this course of treatment and any further orthodontic work will require a full new course of treatment and new treatment fee.
• Once my treatment has finished, I understand that not following the retainer protocol given by BeClear Orthodontics will lead to my teeth moving after treatment and will incur a new treatment fee to correct this tooth movement.
• I understand that removable retainers must be worn every single night indefinitely (forever) after treatment is completed in order to maintain the position of my teeth.
• I hereby authorise BeClear Orthodontics to carry out orthodontic treatment and any other related procedures deemed necessary including radiographs.
• I confirm that I fully understand all of the risks associated with the treatment and have read the documentation provided in relation to these.
• I understand that my treatment fee covers only treatment provided by BeClear Orthodontics.
